By accessing or using the website at salemfenceanddeck.com (the "Site") or by engaging Salem Fence & Deck ("we," "us," or "our") for any services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use the Site or request services from us. We reserve the right to update these terms at any time. Continued use of the Site after changes are posted constitutes acceptance.
Salem Fence & Deck is a residential and commercial deck and fence contractor based in Salem, MA. We provide outdoor construction services including, but not limited to:
All services are subject to a written contract executed between Salem Fence & Deck and the customer prior to commencement of work. The Site is informational only and does not constitute an offer or agreement to provide services.
All estimates are provided free of charge and are valid for 30 days from the date issued unless otherwise stated in writing. An estimate is not a binding contract; work does not begin until a written contract is signed by both parties.
Final pricing may differ from an initial estimate if the scope of work changes at the customer's request, if unforeseen site conditions are discovered once work begins (such as hidden rot, substandard existing structure, or underground obstructions), or if material costs change substantially between the estimate and the start of work. Any change in price will be communicated in writing via a change order before additional work proceeds.
Prices quoted on the Site, in marketing materials, or in general conversation are examples only and do not constitute a binding offer or guarantee of pricing for any specific project.
Project start dates are scheduled after a signed contract and required deposit are received. Start dates are estimates and may be affected by permit processing times, weather conditions, material availability, or other factors outside our control. We will communicate any significant schedule changes as soon as possible.
Cancellations by the customer after a contract is signed may result in forfeiture of any deposit paid, or may be subject to a cancellation fee as specified in the signed contract, to cover costs already incurred for permitting, material orders, or scheduling.
We reserve the right to refuse, suspend, or cancel any project at our discretion, including if site conditions are unsafe, if payment obligations are not met, or if the scope of work changes materially from the signed contract.
Payment schedules are specified in the signed project contract. Typically, a deposit is required before work begins and a final payment is due upon substantial completion. Specific milestones and amounts will be outlined in your contract.
Invoices not paid within the time frame specified in the contract may be subject to late fees as stated in that contract. We reserve the right to suspend work on any project with overdue unpaid invoices.
Accepted payment methods will be stated in your project contract. We do not accept payment methods not listed in the contract without prior written agreement.
Where required by applicable law, Salem Fence & Deck will obtain the necessary building permits before work begins. Permit fees are typically included in the project estimate. The customer is responsible for ensuring that the property address, ownership information, and any HOA or historic district requirements are disclosed to us prior to permitting. We are not responsible for delays caused by a customer's failure to disclose known restrictions. All required inspections will be scheduled and completed as part of the project.
We stand behind the quality of our workmanship. Any workmanship warranty will be stated in your signed project contract.
Materials and products installed are subject to the manufacturer's warranty, not ours. We will provide relevant warranty documentation for materials at project completion. We do not warrant materials against defects that arise from manufacturer issues, customer misuse, improper maintenance, or conditions outside the scope of our work.
The Site and all information on it is provided "as is" without warranty of any kind. We make no representations or warranties about the accuracy, completeness, or suitability of any content on the Site for any purpose.
To the fullest extent permitted by applicable law, Salem Fence & Deck shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising out of or related to the use of our Site, the performance of our services, or any other interaction with us.
Our total liability to you for any claim arising out of or related to our services shall not exceed the total amount paid by you to us for the specific project giving rise to the claim.
All content on the Site - including text, images, logos, and design - is owned by or licensed to Salem Fence & Deck and is protected by applicable intellectual property laws. You may not reproduce, distribute, or use any content from the Site without our prior written permission.

If a dispute cannot be resolved informally, the parties agree to attempt good-faith mediation before pursuing any other legal remedy. Nothing in this section limits either party's right to seek injunctive or other equitable relief in a court of competent jurisdiction.
These Terms and Conditions and any disputes arising from them shall be governed by and construed in accordance with the laws of the Commonwealth of Massachusetts, without regard to its conflict-of-law provisions. Any legal proceedings shall be brought in a court of competent jurisdiction in Massachusetts.
We reserve the right to update these Terms and Conditions at any time. Changes take effect when posted on the Site with an updated effective date. It is your responsibility to review these terms periodically. Continued use of the Site or our services after changes are posted constitutes your acceptance of the updated terms.
